Tenisha Warner, the widow of late “Cosby Show” actor Malcolm‑Jamal Warner, has filed a civil suit in DeKalb County Superior Court alleging breach of a prenuptial agreement and seeking $1.2 million from his mother, Pamela Warner, who serves as the successor trustee of the Warner Family Trust.

Prenuptial Agreement Details

The lawsuit states that Tenisha and Malcolm‑Jamal married on May 23 2022, and the couple signed a prenuptial agreement eight days earlier on May 15 2022. According to the complaint, the agreement required the late actor to obtain and maintain a $1 million term‑life insurance policy naming Tenisha as the sole beneficiary, to pay her a $16,000 tax‑free amount on their wedding day, and to provide $5,000 per month for her role as his chief of staff and assistant while they remained married.

Alleged Breach of Contract

Tenisha contends that Malcolm‑Jamal failed to meet these obligations, which she says left her unable to secure the financial support outlined in the prenup. She claims the breach has forced her to pursue legal action to protect her rights and those of their nine‑year‑old daughter before any statute of limitations expires.

Background on Malcolm‑Jamal Warner’s Death

Malcolm‑Jamal Warner died on July 20 2025 at the age of 54 while on a family vacation in Costa Rica. Authorities reported that he drowned after being caught in a strong current near Playa Cocles in Limon province. The official cause of death was asphyxia, resulting from the body being deprived of oxygen.

Legal Actions Related to the Estate

In addition to the breach‑of‑contract suit, Tenisha has asked the court to prevent the trust assets from being misused during the litigation. She emphasized that she has been the sole provider for her daughter since the actor’s death and needs to ensure that the estate is administered fairly.

Tenisha Warner’s Public Statements

In a statement to ABC News, Tenisha said she spent the past year trying to settle the estate privately and honor her husband’s final wishes for their daughter. She expressed that, as a single mother, she had “no choice but to take action” to protect their interests.

Emotional Capacity and Priorities

During a preview of an interview with CBS Mornings, Tenisha explained that her emotional capacity is limited at times, and she must prioritize her daughter first and herself second. She noted that the interview was conducted before the lawsuit was filed, and she was unaware of the legal dispute at that time.

Pamela Warner’s Tribute

On the first anniversary of her son’s death, Pamela Warner posted a heartfelt tribute on Instagram, describing Malcolm‑Jamal as her son, confidant, and brother. She reflected on the cruelty and greed she perceived in some people, as well as the love and support she received, and expressed regret over unspent moments such as cooking his favorite meals or sharing one last conversation.
